Our Privacy Philosophy

At Pelogic, we believe your work belongs to you.

Our desktop software is designed around a simple principle: the data you create should remain under your control. We believe professional software should help you do your work—not collect it.

Whenever reasonably practical, Pelogic Software processes your work locally on your device rather than in the cloud. During normal operation, your Customer Content remains on your computer. It is not automatically uploaded, synchronized, or transmitted over the Internet.

We intentionally design our software to collect only the limited technical information necessary to license, secure, maintain, support, and improve the Software. We do not design our products to collect, transmit, store, analyze, or otherwise process Customer Content except when you intentionally choose to share it with us, such as when requesting technical support.

When you intentionally choose to share information with Pelogic—for example, by submitting a technical support request—you remain in control of what you provide. We collect only the information reasonably necessary to assist you and retain it only as long as necessary to provide support or comply with applicable legal obligations.

The remainder of this Privacy Policy explains our data practices in detail and describes your rights regarding the information we collect.

Introduction

This Privacy Policy describes how Pelogic, Inc. ("Pelogic," "we," "us," or "our") collects, uses, stores, protects, and shares information in connection with our website, desktop software applications, and related services ("Pelogic Software").

Pelogic, Inc. is the controller of personal information processed in connection with Pelogic Software for purposes of applicable data protection laws.

Most Pelogic desktop applications may be downloaded and used without providing Pelogic with personal information. Certain services—such as purchasing a software license, registering a product, requesting technical support, subscribing to communications, or creating an account where applicable—may require you to provide limited personal information so we can provide those services.

This Privacy Policy is intended to comply with applicable privacy and data protection laws, including the General Data Protection Regulation (GDPR) and the UK General Data Protection Regulation (UK GDPR), where applicable.

Definition of Customer Content

For purposes of this Privacy Policy, Customer Content means any document, CAD model, drawing, image, PDF, text file, project file, design, dataset, or other data, information, or digital content that you create, own, import, open, edit, process, or store using Pelogic Software.

Customer Content does not include technical usage information, diagnostic information, crash reports, licensing information, application performance metrics, or other operational telemetry collected as described in this Privacy Policy. Operational Telemetry is designed to help us understand how the Software performs—not what you create with it.

Our Privacy Commitments

At Pelogic, privacy is not simply a legal obligation—it is a design principle.

Our commitments to you include:

  • Privacy by Design

    Privacy is a core design principle of our Software. We design new features with the goal of minimizing the collection of personal information and Customer Content. When information is needed to license, secure, maintain, support, or improve the Software, we strive to collect only the information reasonably necessary for those purposes.

  • We Minimize Data Collection by Design

    We believe the best way to protect customer data is not to collect it in the first place. Pelogic designs its Software to collect only the limited information reasonably necessary to license, secure, maintain, support, and improve the Software.

  • Your Work Stays on Your Device

    During normal operation, your Customer Content remains local to your computer and under your control.

  • No Hidden Cloud Synchronization

    Pelogic desktop applications do not automatically upload, synchronize, back up, or replicate your Customer Content to Pelogic servers or third-party cloud services. Your Customer Content is transmitted from your device as the direct result of an action you intentionally initiate, such as submitting information as part of a technical support request.

  • We Do Not Collect Customer Content

    During normal operation, Pelogic does not intentionally collect, upload, transmit, store, or analyze your Customer Content.

  • We Collect Only Operational Telemetry

    We collect only the limited technical and usage information reasonably necessary to license, secure, maintain, support, and improve the Software. This information relates to how the Software operates—not the work you perform with it.

  • You Choose What You Share

    If you contact Pelogic for technical support, you decide what information to provide. We collect only the information reasonably necessary to investigate and resolve your request and retain it only as long as necessary to provide support or comply with applicable legal obligations.

  • We Do Not Sell Your Personal Information

    Pelogic does not sell your personal information or Customer Content.

  • We Do Not Use Customer Content for Artificial Intelligence

    Pelogic does not use Customer Content to train or improve artificial intelligence, machine learning models, or similar automated systems.

  • We Are Transparent

    This Privacy Policy explains what information we collect, why we collect it, how we use it, and the choices and rights available to you.

Information We Collect Directly From You

You may choose to provide personal information when purchasing software, activating a license, creating an account in our support portal, where applicable, requesting technical support, subscribing to communications, or otherwise interacting with Pelogic.

Depending on the nature of your interaction, this information may include your email address, licensing information, and any information you voluntarily choose to provide in connection with technical support or other communications. Payment and billing information is collected and processed by FastSpring acting as Merchant of Record.

We request only the information reasonably necessary to provide the products, services, or support you request. You may choose not to provide certain information; however, doing so may limit our ability to provide specific products, services, or support.

Except when you intentionally provide Customer Content as part of a technical support request or other user-initiated communication, Pelogic does not request or collect Customer Content directly from you.

Information We Collect Automatically

During normal operation, Pelogic Software collects only limited technical and usage information necessary to operate, license, secure, maintain, and improve the Software. This information may include software version, operating system version, device characteristics, application performance metrics, feature usage statistics, crash reports, diagnostic information, licensing status, and similar technical information.

This information relates solely to the operation of the Software and does not include Customer Content.

Where required by applicable law, information that could reasonably identify an individual, such as IP addresses, device identifiers, or license identifiers, is processed only for legitimate operational, licensing, security, fraud prevention, or support purposes and in accordance with applicable privacy laws.

How We Use Your Information

Pelogic uses the limited information it collects only for legitimate business purposes related to providing and improving the Software. These purposes include:

  • Providing, licensing, activating, maintaining, and supporting Pelogic Software.
  • Responding to technical support requests and customer inquiries.
  • Processing purchases and license management.
  • Improving software reliability, stability, security, usability, and performance through analysis of operational telemetry.
  • Detecting, preventing, and investigating fraud, abuse, security incidents, and unauthorized use.
  • Complying with applicable laws and legal obligations.
  • Communicating important licensing, security, support, or product information.

Where permitted by applicable law and with your consent where required, Pelogic may also send newsletters, product announcements, educational materials, or other marketing communications.

Pelogic does not use Customer Content for analytics, marketing, product development, targeted advertising, or artificial intelligence training.

Where the General Data Protection Regulation ("GDPR") or the United Kingdom General Data Protection Regulation ("UK GDPR") applies, Pelogic processes personal information only where there is a lawful basis to do so. Depending on the nature of the processing, Pelogic relies on one or more of the following legal bases:

Performance of a Contract

We process information necessary to provide, license, activate, maintain, and support the Software you have requested, including license validation, customer support, and account administration where applicable.

Legitimate Interests

We process limited Operational Telemetry and related information where reasonably necessary to:

  • Maintain software security.
  • Detect and prevent fraud or unauthorized use.
  • Diagnose crashes and technical issues.
  • Improve software reliability, stability, and performance.
  • Develop product enhancements.
  • Protect the integrity of our licensing systems.

We carefully balance these legitimate interests against the privacy rights of our users and collect only the minimum information reasonably necessary for these purposes.

Legal Obligations

We may process personal information where necessary to comply with applicable laws, legal process, regulatory requirements, tax obligations, or lawful requests from governmental authorities.

Consent

Where required by applicable law, we rely on your consent before sending marketing communications or engaging in other processing activities for which consent is legally required. You may withdraw your consent at any time, although doing so will not affect processing that occurred before consent was withdrawn.

How We Share Information

Pelogic does not sell, rent, or trade your personal information or Customer Content.

Because Pelogic Software is designed to process Customer Content locally on your device, Pelogic generally does not receive or possess Customer Content during normal operation of the Software and therefore has no Customer Content to share.

Pelogic shares personal information only where reasonably necessary to provide the Software or where required by applicable law. Depending on the circumstances, we may share limited information with:

  • FastSpring, our authorized Merchant of Record, for payment processing, tax collection, order fulfillment, license management, and related customer service functions.
  • Service providers that perform services on our behalf, such as website hosting, email delivery, customer support systems, or other technology providers. These providers are authorized to process personal information only as necessary to provide services to Pelogic and are contractually required to protect such information.
  • Professional advisors, including attorneys, accountants, auditors, insurers, or similar advisors, where reasonably necessary to obtain professional services or protect Pelogic's legal interests.
  • Government authorities or other third parties where required to comply with applicable law, court orders, legal process, or lawful governmental requests, or where necessary to investigate fraud, protect the security or integrity of the Software, enforce our agreements, or protect the rights, property, or safety of Pelogic, our users, or others.
  • Successors in interest in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or other business transaction involving Pelogic. If such a transaction occurs, personal information will remain subject to applicable privacy commitments or users will be notified as required by applicable law.

Except as described in this Privacy Policy, Pelogic does not disclose personal information to third parties.

International Data Transfers

Pelogic is headquartered in the United States. Personal information collected in connection with the Software may be processed or stored in the United States or other jurisdictions in which Pelogic or its service providers operate.

Where personal information originating in the European Economic Area ("EEA"), the United Kingdom, Switzerland, or other jurisdictions with applicable data protection laws is transferred internationally, Pelogic will implement appropriate safeguards required by applicable law. Such safeguards may include the European Commission's Standard Contractual Clauses or other lawful transfer mechanisms recognized under applicable data protection laws.

Because Pelogic Software is designed to process Customer Content locally on your device, Customer Content is generally not transferred internationally during normal operation of the Software unless you intentionally choose to provide it to Pelogic, such as in connection with a technical support request.

Data Retention

Pelogic retains personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including providing and supporting the Software, maintaining licensing records, improving software reliability and security, complying with applicable legal obligations, resolving disputes, and enforcing our agreements.

Because Pelogic Software is designed to process Customer Content locally on your device, Pelogic generally does not retain Customer Content during normal operation of the Software. If you voluntarily provide Customer Content in connection with a technical support request, Pelogic will retain such information only for as long as reasonably necessary to investigate and resolve the support request, comply with applicable legal obligations, or protect the rights and interests of Pelogic and its users.

Operational Telemetry may be retained for as long as reasonably necessary to support software licensing, security, diagnostics, product improvement, historical product analytics, fraud prevention, legal compliance, and other legitimate business purposes consistent with this Privacy Policy.

When personal information is no longer reasonably necessary for these purposes, Pelogic will delete, anonymize, or securely dispose of the information in accordance with its data retention practices, unless a longer retention period is required or permitted by applicable law.

Your Privacy Rights

Depending on your location and the applicable law, you may have certain rights regarding the personal information Pelogic processes about you. These rights may include:

  • Right of Access. You may request confirmation of whether Pelogic processes your personal information and request access to that information.
  • Right to Correction. You may request that inaccurate or incomplete personal information be corrected.

  • Right to Withdraw Consent. Where Pelogic relies on your consent to process personal information, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing that occurred before consent was withdrawn.
  • Right to Lodge a Complaint. If you believe your privacy rights have been violated, you may have the right to lodge a complaint with your local data protection authority or other applicable regulatory authority.

Because Pelogic Software is designed to process Customer Content locally on your device, Pelogic generally does not possess Customer Content during normal operation of the Software. As a result, many requests relating to Customer Content can be addressed directly by you without requiring action by Pelogic.

How We Protect Your Information

Pelogic maintains administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction. These safeguards are designed to be appropriate to the nature of the information we process and the risks associated with that processing.

Because Pelogic Software is designed to process Customer Content locally on your device, Customer Content generally remains under your control and is not routinely transmitted to or stored by Pelogic during normal operation of the Software. This architecture significantly reduces the amount of customer data that Pelogic receives or stores.

While no method of electronic storage or transmission can be guaranteed to be completely secure, Pelogic continually evaluates and improves its security practices as appropriate to help protect the information entrusted to us.

Users are also responsible for maintaining appropriate security for their own systems, including protecting their devices, installing software updates, maintaining appropriate backups, and safeguarding access credentials and license information.

Marketing Communications

Users are generally not required to provide Pelogic with contact information during normal use of the Software.

Pelogic sends marketing communications only to individuals who have voluntarily provided their contact information—for example, by activating a license, subscribing to a newsletter, requesting product information, or otherwise requesting communications from Pelogic.

Where required by applicable law, Pelogic obtains your consent before sending marketing communications. You may unsubscribe at any time.

Operational communications, such as licensing notices, security updates, support responses, or important product notifications, are not considered marketing communications and may be sent where reasonably necessary to provide the services you have requested.

Children's Privacy

Pelogic Software is intended for use by businesses, professionals, educational institutions, and other users who are legally able to enter into this Agreement. It is not directed to or intended for use by children.

Pelogic does not knowingly collect personal information from children or knowingly market its Software to children. If Pelogic becomes aware that it has collected personal information from a child in violation of applicable law, Pelogic will take reasonable steps to delete such information as soon as reasonably practicable.

Changes to This Privacy Policy

Pelogic may update this Privacy Policy from time to time to reflect changes in our products, services, legal obligations, or privacy practices.

When we make material changes to this Privacy Policy, we will post the updated version on our website and update the "Last Updated" date at the beginning of this Privacy Policy. Where required by applicable law, we will provide additional notice or obtain consent before changes become effective.

Your continued use of the Software after the effective date of an updated Privacy Policy constitutes your acknowledgment of the revised Privacy Policy to the extent permitted by applicable law.
